1. Data Controller & Legal Basis

The Data Controller for your information is 53 Software (legally operated by FOP Prystupa Y. K., Ukraine). We process your data based on the following legal grounds:

  • Performance of a Contract: To provide and validate your software license.
  • Legitimate Interests: To prevent software piracy, ensure network security, and protect our intellectual property (Article 6(1)(f) of the GDPR).

2. Information We Collect

We adhere to the principle of data minimization. We only collect what is strictly necessary for the Software to function:

  • Licensing Data: Your email address (provided by our Merchant of Record, Paddle.com) and a cryptographic one-way hash of your hardware identifier (Motherboard UUID). We cannot reverse-engineer this hash to identify your specific hardware components.
  • Security & Anti-Fraud Data: During activation and periodic validation, we log your IP address. This is used solely to enforce our "one active session" rule and prevent unauthorized key distribution.
  • Technical Metadata: The Software version and your OS type to provide targeted updates and support.

3. Third-Party Processors

We rely on trusted partners to provide our services:

  • Paddle.com: Our Merchant of Record that handles all payments and taxes. We do not see or store your credit card details.
  • Cloudflare, Inc.: Hosts our licensing API, protects our services, and provides privacy-first web analytics (without using cookies).
  • Brevo (Sendinblue): Used for the delivery of transactional emails (such as license keys), technical notifications, and support communication.

4. Data Retention

We store your Licensing Data as long as your license is active to provide you with the service. Security Data, such as IP addresses, is retained for a limited period. Security logs are automatically anonymized or deleted after 90 days, unless an IP address is associated with fraudulent activity, in which case it may be retained longer as necessary for our legitimate interests in protecting our service.

5. Children's Privacy

Our Software is not directed to children under the age of 13 (or 16 in the European Union). We do not knowingly collect personal data from children. If we become aware that we have inadvertently collected data from a child without parental consent, we will delete such data immediately. 6. Your Rights (GDPR & CCPA/CPRA)

You have rights over your personal data, regardless of your location. These include:

  • Right to Access/Know: You can request a copy of the personal data we hold about you.
  • Right to Erasure/Delete: You can request that we delete your personal data. Please note that fulfilling this request will terminate your software license, as we will no longer be able to validate it.
  • Right to Correct: (For California residents) You can request the correction of inaccurate personal information.
  • Right to Object (GDPR): You can object to our processing of your data based on legitimate interests.
  • Right to lodge a complaint with a supervisory authority (GDPR).

7. EU Representative

As we are based outside the European Union, if required by Article 27 of the GDPR, we will designate a representative within the EU to act as a point of contact for data protection authorities and individuals in the EU.
